1. Uso libre para visitantes
Cualquier persona puede escuchar en línea y compartir mediante enlace las melodías publicadas en shemakoli.com, sin necesidad de registrarse. Las melodías no se ofrecen para descarga.
2. Registro para aportar contenidos
Para aportar melodías es necesario registrarse, ser mayor de edad y firmar electrónicamente la declaración responsable de titularidad de derechos y exención de responsabilidad que figura más abajo. Si el texto de la declaración cambia, se pedirá una nueva firma antes de la siguiente subida.
3. Contenido de cada aportación
Cada melodía debe incluir: título, autor (o «Tradicional»), sección según el rito o festividad, una descripción y el audio. Opcionalmente puede incluir el texto en PDF. Todos los audios se convierten a formato MP3.
4. Revisión previa
Ninguna aportación es pública hasta que el titular la aprueba. El titular puede corregir los datos descriptivos (título, autor, sección, descripción), rechazar o retirar cualquier aportación sin necesidad de justificarlo.
5. Cesión gratuita y permanente
Al enviar una aportación, quien la sube cede al titular, de forma gratuita, no exclusiva e irrevocable, los derechos necesarios para publicarla y explotarla a través de la web, en los términos de la declaración que figura más abajo. Una vez publicada, la aportación forma parte del archivo de shemakoli.com y no se retirará a petición de quien la subió, salvo que la ley le reconozca un derecho irrenunciable. Mientras no esté publicada, puede retirarse libremente desde «Mis aportaciones».
6. Posible monetización
Hoy ShemaKoli es gratuita y sin publicidad, y se sostiene con donativos voluntarios. El titular se reserva la posibilidad de monetizar la web en el futuro, por ejemplo con publicidad, patrocinios o contenidos y servicios de pago. Quienes aportan contenidos aceptan que esa explotación no les genera derecho a remuneración ni compensación alguna.
7. Normas
- Sólo se admiten melodías y textos relacionados con la tradición, la liturgia y las costumbres judías.
- No se admite contenido del que no tengas los derechos o la autorización necesaria.
- No se admite contenido ofensivo, discriminatorio, comercial o publicitario.
- Los datos (autor, origen) deben ser lo más exactos posible.
8. Denuncias y retirada
Cualquier persona puede denunciar un contenido desde su página. El titular revisará la denuncia y, si procede, retirará el contenido. Quien aportó el contenido responde de él frente a terceros conforme a la declaración que firmó.
9. Donativos
Los donativos son voluntarios, no dan derecho a ninguna contraprestación y no son reembolsables. Quien lo solicite recibirá un recibo. Como el titular es una persona física y no una entidad sin ánimo de lucro, los donativos no dan derecho a deducción fiscal.
10. Baja
Puedes solicitar la baja de tu cuenta escribiendo a galichybentolila@gmail.com. Tus aportaciones ya publicadas se mantendrán en el archivo conforme al apartado 5. El titular puede bloquear cuentas que incumplan estas condiciones.

DECLARATION OF RIGHTS OWNERSHIP AND RELEASE FROM LIABILITY

Website owner: Messod Fortunato Bentolila Alfón, Spanish tax ID (NIF) 45.077.061-M (the “Owner”).
I, the person signing below with my full name (the “User”), DECLARE AND AGREE as follows regarding all content (audio recordings, texts, PDF documents, titles, descriptions and any other material) that I upload to shemakoli.com:
1. ACCURACY. The details I provided when registering are true and identify me. I am of legal age and have the legal capacity to sign this declaration.
2. OWNERSHIP OF RIGHTS. For each item I upload, I declare under my sole responsibility that:
a) I am the author and/or performer of the work and of the recording, or
b) I have express and sufficient authorisation from all intellectual property rights holders (authors, composers, performers, producers of the recording and publishers of the text), or
c) the work is in the public domain or part of popular tradition, and the recording is mine or I have the right to distribute it.
I also declare that I have the consent of every person whose voice or image appears in the content.
3. GRANT OF RIGHTS. I grant the Owner, free of charge, on a non-exclusive and irrevocable basis, worldwide and for the full term of protection of the rights, the rights of reproduction, distribution, communication to the public (including making available to the public online) and transformation, the latter limited to format conversion, trimming, sound improvement and technical adaptation, over the content I upload, for its exploitation through shemakoli.com and the applications, channels and services linked to it, INCLUDING FOR COMMERCIAL PURPOSES. In particular, the Owner may include advertising or sponsorship, offer paid content or services and earn income from the website, and I shall have no right to any remuneration, compensation or share of that income. I keep the rights I do not grant and remain free to use my content. My public name will continue to appear next to my contribution.
4. PERMANENCE. Once published, the content becomes part of the shemakoli.com archive and I cannot demand its removal, even if I close my account, except where the law grants me a right that cannot be waived. The Owner may, however, remove any content whenever he sees fit. While a contribution is not yet published, I may withdraw it freely.
5. SOLE RESPONSIBILITY. I am solely responsible for the content I upload and its lawfulness. In the event of any claim, demand, complaint, lawsuit or penalty by a third party or an authority relating to that content (including those arising from copyright, related rights, image rights, data protection or reputation), I assume full responsibility and RELEASE the Owner, Messod Fortunato Bentolila Alfón, from any liability. I undertake to hold him harmless and to compensate him for all damages, losses, costs and expenses (including reasonable legal fees) he may incur as a result.
6. PROHIBITED CONTENT. I will not upload content that infringes third-party rights, is offensive, discriminatory, unlawful or unrelated to the purpose of the site (melodies and texts of the Jewish tradition), nor personal data of third parties without their consent.
7. MODERATION AND REMOVAL. I understand that no content is published without the Owner’s prior approval, that the Owner may refuse or remove it at any time without having to give reasons, and that the Owner will act diligently to remove any content once aware that it may be unlawful or infringe third-party rights. I agree to cooperate by providing any information requested in connection with a claim.
8. ELECTRONIC SIGNATURE AND EVIDENCE. By typing my full name and ticking the acceptance box, I electronically sign this declaration, with the same validity as a handwritten signature for all legally permitted purposes. I agree that the date and time of acceptance, my IP address, my browser details and a complete copy of this text are kept as evidence.
9. GOVERNING LAW. This declaration is governed by Spanish law. The Courts of Ceuta (Spain) shall have jurisdiction over any dispute, without prejudice to any forum to which the User may be entitled under consumer protection law.
This declaration is offered in Spanish, English, French and Hebrew. In case of any discrepancy, the Spanish version prevails.
